What to do, step by step

  1. Seek medical care immediately and ask for a certificate or report describing the injury or illness.

  2. The employer must issue the CAT (Work Accident Notification); if Fast Shop does not issue it, the worker, their dependents, the union, the doctor or a public authority may do so (art. 22 of Law 8.213/91).

  3. If you are away from work for more than 15 days, apply for the incapacity benefit with the INSS (National Social Security Institute) through Meu INSS or by phone at 135.

  4. Workers who receive the temporary work-accident incapacity benefit have 12 months of job stability after discharge (art. 118 of Law 8.213/91).

  5. Keep exams, reports, the CAT, communications and payslips (holerites); if in doubt, contact your union, the MTE (Ministry of Labor and Employment, Disque 158) or a lawyer.

Frequently asked questions

What is the CAT?

It is the document that records the accident or occupational illness with the INSS. It helps prove the connection to work and secure rights during the leave.

Does an occupational illness also give job stability?

It may, when there is a leave with receipt of a work-accident benefit or recognition of the connection to work. The analysis depends on the specific case.

Is there compensation in addition to the INSS benefit?

In some situations, the Labor Court considers claims for material and moral damages. There is no guarantee of result: each case depends on evidence and context.
