Sales staff: commissions and DSR
Rodobens

Do you work or did you work in sales at Rodobens? Understand commissions, paid weekly rest (DSR), commission chargebacks and sales targets.

Updated on

What to do, step by step

  1. Keep your contract, payslips (holerites), sales reports, target spreadsheets and messages about commissions from Rodobens.

  2. Check that commissions are correct and that paid weekly rest (DSR) is calculated on them (Law 605/49 and TST Súmula 27 (Brazilian Superior Labor Court precedent)).

  3. A commission chargeback is only allowed in the situations provided by law, such as the buyer’s insolvency (Law 3.207/57); check whether the deduction followed these rules.

  4. Check overtime, rest breaks and working-time records, which are often points of attention in stores and dealerships.

  5. Contact the sector union, MTE (MTE, Brazil’s Ministry of Labor and Employment, Disque 158) or a lawyer; a lawsuit must be filed within 2 years after the end of the contract.

Frequently asked questions

Is commission part of salary?

As a rule, yes. Commissions are salary in nature and may affect vacation pay, the 13th salary, FGTS (Brazilian severance fund) and DSR. Each case must be analysed individually.

Can the company charge back the commission on a cancelled sale?

A chargeback depends on the sale genuinely not having been completed and on the applicable legal and contractual rules. Deductions without justification may be challenged.

Are people who work on commission only entitled to a minimum?

Workers are entitled to at least the minimum wage or the sector wage floor, depending on the case. Check the contract and the collective agreement.
