Hyundai

Do you work or did you work on the production line at Hyundai? Understand unhealthy-conditions and hazard pay, PLR (profit sharing) and lay-off.

Updated on

What to do, step by step

  1. Gather your contract, payslips (holerites), technical reports, PPP (Perfil Profissiográfico Previdenciário, occupational exposure profile) and communications from Hyundai about risks, additional pay and profit sharing.

  2. Work in unhealthy or hazardous conditions may entitle you to additional pay (arts. 189 to 193 of the CLT (Brazilian Labor Code)), according to the regulatory standards and a technical inspection.

  3. Profit or results sharing (PLR) follows Law 10.101/2000 and the sector collective agreement; check the payment and proportionality rules.

  4. In case of temporary suspension of the contract (lay-off), conditions depend on collective bargaining and the law (art. 476-A of the CLT); keep the notices and agreements.

  5. Contact the metalworkers’ union, MTE (MTE, Brazil’s Ministry of Labor and Employment, Disque 158) or a lawyer; a lawsuit must be filed within 2 years after the end of the contract.

Frequently asked questions

How do I know if I am entitled to unhealthy-conditions pay?

As a rule, the activity must be classified as unhealthy under the regulatory standards, which is usually proven by a technical inspection. Each case must be analysed individually.

Is PLR part of salary?

When paid in accordance with the law, PLR is not salary (art. 3 of Law 10.101/2000). Amounts paid outside those rules may be challenged.

What is lay-off?

It is the temporary suspension of the employment contract for professional training, which depends on a collective agreement and on legal requirements (art. 476-A of the CLT).
