What to do, step by step

  1. Gather your contract, payslips (holerites), technical reports, PPP (Perfil Profissiográfico Previdenciário, occupational exposure profile) and shift and on-call schedules for your work at CPFL.

  2. Workers exposed to risk from electricity may be entitled to hazard pay (art. 193 of the CLT (Brazilian Labor Code)); check NR-10 (Brazil’s regulatory standard on electrical safety) and the technical report.

  3. Check whether the extra pay was calculated on the correct base (for electric utility workers, the base has its own rule in TST Súmula 191 (Brazilian Superior Labor Court precedent)) and whether it appears on your payslips and in their knock-on effects.

  4. Shifts and on-call time (sobreaviso) may give rise to specific rights; keep schedules and records of call-outs.

  5. Contact the sector union, MTE (MTE, Brazil’s Ministry of Labor and Employment, Disque 158) or a lawyer; a lawsuit must be filed within 2 years after the end of the contract.
