Bank employees: working hours and trusted position
Santander

Do you work or did you work as a bank employee at Santander? Understand the 6-hour workday, the trusted position and overtime in the banking sector.

Updated on

What to do, step by step

  1. Gather your contract, payslips (holerites), time records and communications about your position and working hours at Santander.

  2. The bank employee workday is, as a rule, 6 hours a day, Monday to Friday (art. 224 of the CLT (Brazilian Labor Code)), except for legal or collective-agreement exceptions.

  3. Those in a position of trust work 8 hours and receive an allowance of at least 1/3 of the salary of the base position (art. 224, §2, of the CLT); the job title alone does not settle the matter, and the subject is widely debated in the courts.

  4. Check your payslips for overtime, its knock-on effects and the additional payments provided in the sector collective agreement.

  5. Contact the bank workers’ union, MTE (MTE, Brazil’s Ministry of Labor and Employment, Disque 158) or a lawyer; a lawsuit must be filed within 2 years after the end of the contract.

Frequently asked questions

Does every bank employee work 6-hour days?

As a rule, yes, but those in a position of trust may work 8 hours if the legal requirements are met. Each case depends on the duties actually performed.

Does being a manager mean holding a position of trust?

Not necessarily. The analysis looks at the duties actually performed, such as the degree of autonomy and trust, and not only the job title.

Does the bank workers’ collective agreement change any rule?

It may supplement or detail rights, such as additional payments and profit sharing. Consult the sector union to learn which rule applies.
