Frequently asked questions
What is a wrongful credit listing?
It is the inclusion of your name in default registries (Serasa, SPC) for a debt that does not exist, has been paid, is time-barred, or is not recognized.
Must the company notify me before listing my name?
Yes. The credit protection agency must notify you in writing before the listing (art. 43, § 2, of the CDC, Brazilian Consumer Protection Code). Lack of notice may make the listing irregular.
Can a wrongful listing lead to compensation?
Courts generally understand that wrongful credit listing causes moral damages. Each case, however, depends on the evidence and circumstances.
How quickly should the name be cleared after payment?
After the debt is paid, removal of the listing should occur within 5 business days, according to STJ understanding.
